Participant agrees that no guarantee of income levels or future earnings have been promised to them.
Purchase Agreement:
With the purchase of The MD Needle Pen online training class or any other products associated with the company the buyer takes the responsibility to know their state regulations and get hands-on training on the use accordingly. The user manual accompanying the purchase is a guide and does not take into consideration individual patients health and skin conditions. It is the buyer’s responsibility to know each patients health, skin condition and evaluate the risks associated with a microneedling treatment.
Indemnification:
Buyer agrees to hold harmless MD Needle Pen and its directors, officers, employees and agents from any and all claims, losses, liabilities, costs and expenses (including attorney's fees) arising out of or related the information within the class and/or use of any microneedling device.
Buyer hereby assumes the entire responsibility and liability for, any and all damage or injury of any kind or nature whatever, as to all persons, whether Buyer's employees, agents or otherwise, and as to all property, including Buyer's own property, caused by, resulting from, arising out of, or occurring in connection with, the use by Buyer himself or any other person, of any microneedling device or information gained from this class.
No Liability for Damages:
To the maximum extent permitted by any law, in no event shall the company be liable for any direct, indirect, punitive, incidental, special consequential damages, to property or life, whatsoever arising out of or connected with the use or misuse of the information provided in this training course. This includes loss of business profits, business interruption or pecuniary loss arising out of the use or inability to use this product, even if the company has been advised of the possibility of such damages.
Personal and Non-Commercial Use of information:
The products and information are provided solely for the participants personal and non-commercial use. The participant may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transform or sell any information, products, goods or services obtained from this class.
Disclaimer of Warranties and Liability/No Representations or Guarantees:
Participant expressly agrees that their use of the information provided within this internet site and the products and services offered by MD Needle Pen is at the participants own risk. All such information, products and services being provided to participant without any warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, MD Needle Pen disclaims all warranties, express or implied, including without limitation, implied warranties merchantability, fitness for a particular purpose, and no-infringement or other violation or rights.MD Needle Pen makes no warranties, guarantees or representations regarding the use or the results of the use of any of the products and services offered by MD Needle Pen.
Right to Use:
Participant agrees to allow MD Needle Pen and any of its affiliates, subsidiaries, agents, representatives, publishers, distributors, advertisers, licensees, successors and assigns the right to use participants name, images, profiles, and business in promoting, exhibiting, advertising, marketing, and publicizing MD Needle Pen and any of the products and services provided by MD Needle Pen.
Refunds:
No refunds will be given after the purchase due to proprietary information available within the course.
